Acceptance of Terms

By downloading, installing, or using Hawaii Ocean Map ("the app"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the app.

Description of Service

Hawaii Ocean Map is an informational and recreational application that displays bathymetry (seafloor depth) data, regulatory zone boundaries, and points of interest for the Hawaiian Islands. The app provides depth queries, placemarks, GPS track recording, distance measurements, map layers, and waypoint navigation features.

The app is designed for informational and recreational purposes only. It is not a marine navigation device and is not intended to replace official nautical charts or navigation equipment.

NOT FOR MARINE NAVIGATION

WARNING: This app is NOT a marine navigation device. Do not rely on this app for nautical navigation decisions. All data in this app — including depth, regulatory zone boundaries, and points of interest — is provided for reference only and may be inaccurate, incomplete, or outdated.

Bathymetry data is derived from NOAA CUDEM scientific modeling data, not from official nautical charts. Depths displayed may differ significantly from actual conditions due to:

Different vertical reference datums than nautical charts
Tidal variations (you may encounter shallower water than displayed, especially at low tide)
Seasonal changes to the seafloor
Data collection limitations and processing artifacts
Updates to the seafloor since the data was collected

Always verify current regulations, use official nautical charts, and carry proper marine navigation equipment. Nautical charts are the authoritative source for marine navigation and are updated more frequently for hazards, obstructions, and depth changes. Regulatory zone boundaries and rules may change without notice.

Assumption of Risk

You acknowledge that ocean and water-based activities are inherently dangerous and carry significant risks, including but not limited to drowning, injury, vessel damage, and death. By using this app, you voluntarily assume all risks associated with your activities, whether or not you use information from this app in connection with those activities.

You agree that you are solely responsible for your own safety and the safety of others when engaging in any ocean, boating, fishing, diving, swimming, or other water-related activity. The app does not replace proper training, equipment, judgment, or seamanship.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER OF HAWAII OCEAN MAP SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

Personal injury, death, or bodily harm
Property damage or vessel damage
Loss of data or information
Loss of profits, revenue, or business opportunities
Any damages arising from reliance on depth data, navigation features, or any other information provided by the app

This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise), even if the developer has been advised of the possibility of such damages.

No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

The developer does not warrant that:

The depth data or any other information displayed is accurate, complete, current, or reliable
The app will meet your requirements or expectations
The app will be uninterrupted, timely, secure, or error-free
Any errors in the app or its data will be corrected

Data Accuracy

All data displayed in this app — including bathymetry, regulatory zone boundaries, and points of interest — is derived from publicly available sources and is provided for informational purposes only. The developer makes no representations or warranties regarding the accuracy, completeness, or timeliness of any data. Actual ocean depths, zone boundaries, regulations, and conditions may vary significantly from what is displayed in the app.

Indemnification

You agree to indemnify, defend, and hold harmless the developer of Hawaii Ocean Map from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the app, your violation of these Terms, or your activities in connection with any information obtained from the app.

User Conduct

You agree to use the app responsibly and in compliance with all applicable laws and regulations, including maritime and boating safety laws. You agree not to use the app as a substitute for proper navigation equipment, official nautical charts, or sound seamanship practices.

Intellectual Property

The app, its design, features, and original content are the intellectual property of the developer. NOAA bathymetry data used in the app is in the public domain. This app is not affiliated with or endorsed by NOAA.

Changes to Terms

The developer reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the app after any changes constitutes acceptance of the revised Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Hawaii, United States, without regard to its conflict of law provisions.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
